These Terms and Conditions ("Agreement") govern the use of services provided by Flare Global Soft ("Service Provider", "we", "us", or "our") to you, the client ("Client", "you", or "your"). By using our services, you agree to be legally bound by this Agreement.
- Scope of Services: We commit to delivering the services as outlined in your project specifications. While we strive to meet all deadlines, exact delivery times and outcomes cannot be guaranteed.
- Payment Terms: Payment must be made in full as per the invoice, either upon service completion or as mutually agreed in writing. All payments are non-refundable.
- Intellectual Property Rights: You retain all rights to content you provide. We retain ownership of any custom-developed software, code, or applications, which you may use solely for operating the delivered solution.
- Confidentiality: Both parties agree to keep all proprietary or confidential information shared during the course of service strictly confidential.
- Limitation of Liability: We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or data. Our total liability shall not exceed the fees paid by you for the specific service in question.
- Termination: Either party may terminate this Agreement with written notice. Upon termination, you remain liable for all fees incurred up to the termination date.
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
- Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral.
